Foundations of HR & Employment Law
Workplace policy incorporation by reference
A legal technique that makes an employee handbook or separate policy legally part of an employment agreement without rewriting it into the offer letter.
"I want my handbook to bind employees but I don't want 50 pages in every offer letter."
Incorporation by reference is a clause in an employment contract that identifies an external document (like a handbook) and makes its terms enforceable as if included in the contract, provided the referenced document is clearly identified and accessible when the agreement is formed.
